The business world was still adapting to the evolving landscape of remote work when, on April 26, 2023, a ground-breaking amendment to the Labour Code took effect, bringing forth a wave of positive transformations inspired by two European directives: the Work-Life Balance Directive (Directive (EU) 2019/1152) and Directive 2019/1158. These fresh regulations have been strategically designed to empower employees and foster a harmonious blend of personal and professional lives.

1. Unpaid Carer’s Leave: In recognition of the vital role individuals play as caregivers, employees now have the right to avail themselves of additional unpaid leave to personally attend to their relatives or household members who require critical medical care or support. This compassionate provision allows for 5 days of leave per year, enabling employees to be there for their loved ones in times of need.
2. Parental Leave: The duration of parental leave has been extended by a remarkable 9 weeks, providing families with 41 weeks of leave in the case of the birth of a single child, and 43 weeks in the case of multiple births. This additional leave cannot be transferred between parents and can be utilized in up to five separate parts until the child reaches the age of six. Parents who were eligible for parental leave prior to the implementation of these new regulations, as well as those with children born from August 2, 2022 onwards, can avail themselves of this extended period. Moreover, with the increased leave duration, parents now have an extended period to strike a balance between work and family responsibilities.
3. Embrace Flexibility: For employees raising children up to the age of eight, a world of flexibility awaits. You now have the right to request a customised work organisation, which could include options like remote work, reduced working hours, or adopting one of the flexible working time systems such as the interrupted working time system, shortened working week system, or weekend work system. You can even submit your request online, making it more convenient than ever before. Within seven days, your employer will thoughtfully consider your application, taking into account both your needs and the company’s requirements and capabilities. The employer may choose to grant your request, or if necessary, provide reasons for refusal, ensuring transparency and open communication.
4. Supporting Urgent Family Matters: Life can sometimes throw unexpected challenges our way, especially when it comes to our families. In urgent cases of family illness or accidents that demand your immediate presence at home, you now have the right to take 2 days or 16 hours off work. During this leave, you’ll continue to receive half of your regular remuneration, providing some peace of mind during difficult times. Part-time employees will have their leave duration adjusted proportionally to their working hours. Remember, be sure to submit your request on the day you plan to use this leave.
5. Embrace New Opportunities: Gone are the days when employers could restrict you from pursuing simultaneous employment opportunities. The updated Labour Code explicitly states that employers cannot prevent employees from working elsewhere or engaging in different forms of employment. This freedom of choice is now legally protected, ensuring you can explore diverse professional avenues without any undue restrictions. Additionally, employers are prohibited from exploiting your right to simultaneous employment as grounds for termination, safeguarding your job security.
6. Empowering Employee Contracts: You now have the right to request a change in your employment contract to an indefinite-term contract or one that offers more predictable and secure working conditions. Your employer should endeavour to accommodate your request whenever possible. In the rare event of refusal, the employer must provide clear reasons for their decision. It’s important to note that you can make such a request once per calendar year, giving you the opportunity to shape your employment in a way that best suits your needs.
